BUCK’S SCRATCH-OFFS OFFICIAL RULES

Effective Date: October 1, 2025

NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. RESIDENTS OF RHODE ISLAND ARE NOT ELIGIBLE TO PARTICIPATE.
THESE OFFICIAL RULES MAY BE POSTED IN ENGLISH AND SPANISH. IN THE EVENT THERE IS A DISCREPANCY OR INCONSISTENCY BETWEEN THE ENGLISH-LANGUAGE VERSION AND THE SPANISH-LANGUAGE VERSION OF THESE OFFICIAL RULES AND/OR OF ANY OTHER WRITTEN MATERIALS RELATED TO THE SCRATCH-OFF, THE ENGLISH-LANGUAGE VERSION SHALL PREVAIL, GOVERN, AND CONTROL.
The Buck’s Scratch-Offs (the “Scratch-Off”) is sponsored by Bahama Buck’s LLC, located at 5741 50th St. Lubbock, Texas 79424. Bahama Buck’s Franchise Corporation and its licensees, parent, subsidiaries, affiliates, successors, and assigns are referred to throughout these Official Rules as “Bahama Buck’s”.

ELIGIBILITY
Except as otherwise provided in these Official Rules, participation in the Scratch-Off is available to any legal resident of the United States and Puerto Rico, unless otherwise prohibited by law, who is at least 16 years old at the time of participation. Employees of Bahama Buck’s or any other companies associated with the promotion of the Scratch-Off, and their respective parents, subsidiaries, affiliates, and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee, are not eligible to participate in the Scratch-Off. The Scratch-Off is subject to federal, state, and local laws and regulations and is void where prohibited or restricted by law.

AGREEMENT TO OFFICIAL RULES
Participation in the Scratch-Off constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Bahama Buck’s, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

SCRATCH-OFF PERIOD
The Scratch-Off begins on October 1, 2025 at 8:00 a.m. CT and will terminate when all Scratch-Off Cards (“Cards”) are no longer made available (the “Scratch-Off Period”).

PARTICIPATION IN THE SCRATCH-OFF
To participate in the Scratch-Off, a Participant must either: (1) Complete a purchase at a participating Bahama Buck’s location and receive one Card, or 2) Receive a Card Without Purchase (alternate method of entry “AMOE”): A Participant can request a Card without making a purchase at a participating Bahama Buck’s location by mailing a legibly handwritten, self-addressed, stamped envelope (“SASE”) with a return address, including first and last name, street address, city, state, and ZIP code to: Bahama Buck’s Card Request, 5741 50th St., Lubbock, TX 79413. One Card will be mailed in response to each mail-in request that complies with the requirements while supplies last. Limit one request per person per day. Outer envelope must include a return address in the upper left hand corner that matches the requestor’s street address. Bahama Buck’s is not responsible for Cards that are lost, late, misdirected, ineligible and/or incomplete due to mail delivery service, or other error. Each person who completes a purchase at a participating Bahama Buck’s location or a AMOE, in accordance with these Official Rules will be considered a “Participant”.

PRIZES AND CARDS
Each Bahama Buck’s location is independently owned and operated. Official Rules may apply and offerings may vary by location, and based on applicable state laws and regulations. A purchase will not improve one’s chances of winning. Odds of winning vary by participation. No cash value. Must redeem instant or discount offers in person on a subsequent transaction. No substitutions. Not valid with other offers.

Grand Prize Cards
Grand Prize Cards are defined as 1) Free Bahama Buck’s for a Year for you and a friend and 2) Nintendo Switch™ 2 Console with Bahama Buck’s Console wrap. Free Bahama Buck’s for a year for you and a friend is defined as one free product reward up to $10 value valid for 7 days every week for 52 weeks for each two recipients. This will be administered through a Surf Club Rewards account. Approximate Retail Value (“ARV”) $520. Nintendo Switch 2 console with Bahama Buck’s branded console wrap is defined as one (1) Nintendo Switch 2 console with custom Bahama Buck’s design console wrap. ARV $519.48. Grand prize winners will be required to provide proof of identity, (drivers licenses or another form of identification) and to sign and return to the Bahama Buck’s Support Center any legal documents that Bahama Buck’s may require including, but not limited to, tax forms and a Winner’s Affidavit (which may contain a publicity release) (“Prize Verification Forms”), within the amount of time specified in the communication by which Bahama Buck’s delivers the Prize Verification Forms to the potential Grand Prize winner. If a potential grand prize winner does not timely sign and return the Prize Verification Forms to Bahama Buck’s, or chooses not to accept the prize, such potential winning Participant will be disqualified.

Instant Winning & Discount Cards
Instant Winning & Discount Cards are defined as 1) FREE Small Sno® (ARV $4.39), 2) FREE Small Island Smoothie (ARV $6.89), 3) FREE Regular Bahama Soda (ARV $3.79), 4 ) $2 OFF  Red Bull® Infusion, 5) $3 OFF any Bowl (ARV $3.00), 6) BOGO Sno® (ARV $4.39), 7) BOGO Any Product (ARV $5.79). Instant Winning & Discount Cards may be redeemed by presenting a Card at checkout in-shop only. Limit one offer per guest per visit. Additional Tropical Toppings and Add-Ons are available for an extra charge. Cannot be combined with other offers, discounts, or promotions. Excludes catering items.

GENERAL CONDITIONS
In the event that the operation, security, or administration of the Scratch-Off is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Scratch-Off is unable to run as planned for any other reason, as determined by Bahama Buck’s in its sole discretion, Bahama Buck’s may, in its sole discretion, either (a) suspend the Scratch-Off to address the impairment and then resume the Scratch-Off in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Scratch-Off. Bahama Buck’s reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Scratch-Off or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the platform or undermine the legitimate operation of the Scratch-Off may be a violation of criminal and civil law, and should such an attempt be made, Bahama Buck’s reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by Bahama Buck’s to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

PUBLICATION AND LICENSE
Winning Participants of the Scratch-Off grants to Bahama Buck’s an irrevocable, perpetual, worldwide, royalty-free, unlimited, freely transferable license to print, publish, display, broadcast, distribute, reproduce, use and otherwise exploit the winning Participant’s name, voice, statement, picture or other likeness, without additional compensation, in any media now known or hereinafter known for any purpose whatsoever, including public relations, advertising and promotional purposes as may be determined by Bahama Buck’s. Nothing herein will obligate Bahama Buck’s to make any use of any of the rights set forth herein. Check local laws for any restrictions or limitations regarding this license grant.

RELEASE AND LIMITATIONS OF LIABILITY
By participating in the Scratch-Off, Participants agree to release and hold harmless Bahama Buck’s, and its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Scratch-Off, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim, cause of action, judgment, costs, damages, losses, expenses and liabilities, (whether arising under a theory of contract, warranty, tort, strict liability, product liability or any other theory) that may be suffered by participant or any third party as a result of participation in the Scratch-Off, acceptance, receipt, use or nonuse of the prize (including any travel or activity related thereto), Bahama Buck’s use of my name, voice, statement, picture or other likeness, or Bahama Buck’s use of the Participant as permitted hereunder (including but not limited to claims of false endorsement or infringement of rights of publicity or privacy), even if such harm is caused solely by the recklessness, negligence or fault of one or more Released Parties. The Released Parties are not responsible for any claims, damages, expenses, costs or losses to any person (including death) or property of any kind resulting from or arising from or in connection with, in whole or in part, directly or indirectly. : (a) any technical errors associated with the Scratch-Off, including lost, interrupted or unavailable Internet Service Provider, network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Scratch-Off; (c) mechanical, network, electronic, computer, human, printing, language-translation, or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Scratch-Off, including, without limitation, errors that may occur in the administration of the Scratch-Off. Participant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Scratch-Off, and in no event shall the Participant be entitled to receive attorneys’ fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Scratch-Off. Participant waives all rights and claims to special, incidental, punitive, consequential, direct, or indirect damages whether foreseeable or not, and whether based on negligence or otherwise. Some jurisdictions may not allow limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply. Check local laws for any restrictions or limitations regarding these releases and limitations of liability.

DISPUTES
Except where prohibited, each Participant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Scratch-Off or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Lubbock County, Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Participant rights and obligations, or the rights and obligations of Bahama Buck’s in connection with the Scratch-Off, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Texas.
